In the Contract Law seminar, we already discussed how important the burden of proof and the burden of presentation are in civil proceedings. Many are familiar with sayings like “What is written down stands” or “Being right and getting justice are two different things.” This is often linked to those fine-print, easily overlooked contract clauses that we’re all too happy to ignore because they seem cold and hard to swallow.

As consumers, our reluctance to read terms and conditions rarely comes back to haunt us. As entrepreneurs, however, we should invest time in this area. But how do you go about drafting your own terms and conditions? Where can you turn for guidance? And how can a well-crafted framework help you actually develop an interest in terms and conditions?
